1. About These Terms

These Beta Terms of Use ("Beta Terms") govern your participation in the Curilum Beta Program (the "Beta Program") operated by Satyhra GmbH, a GmbH registered in Switzerland (collectively "Curilum", "we", "us", "our").

By accessing or using the Beta Program, you ("you", "User", "Beta Tester") agree to be bound by these Beta Terms. If you do not agree, do not use the service.

These Beta Terms constitute the complete agreement governing your use of the Curilum service during the Beta Program. When the Beta Program ends, updated terms will govern continued use (see Section 16).

2. Beta Nature of the Service

2.1 Pre-release Software

The Curilum service during the Beta Program is pre-release software. It is provided for testing and evaluation purposes only. You acknowledge and accept that the service:

  • Is under active development and may contain bugs, errors, and defects
  • May have features that change, break, or are removed without notice
  • May experience downtime, data loss, or degraded performance
  • Is not production-ready and should not be used for mission-critical purposes
  • May have performance, reliability, or security issues that would not be acceptable in a production release

2.2 No Service Level Agreement

During the Beta Program, we provide NO uptime guarantees, NO SLAs, and NO guaranteed response times for support. We may suspend, restrict, or terminate the service or your access at any time, with or without notice.

2.3 Data Loss Risk

You acknowledge that data loss is possible during beta. While we take reasonable backup measures, we do not guarantee data preservation. You are responsible for maintaining your own copies of any data that is important to you (e.g., downloaded PDFs of generated resumes).

3. Beta Access (Invitation-Only)

3.1 Invite Codes

Access to the Beta Program is by invitation only. To create an account during the Beta Program, you must provide a valid invite code issued by Curilum or an authorized referrer.

3.2 Code Restrictions

Invite codes:

  • Are non-transferable to anyone except as explicitly permitted
  • May have a limited number of uses
  • May expire after a specified date
  • May be revoked at any time by Curilum
  • May not be sold, traded, or publicly posted

Attempting to bypass the invite-code system or using codes obtained fraudulently is a material breach of these Beta Terms and may result in immediate termination.

3.3 Eligibility

You must be at least 16 years old to participate in the Beta Program. By accepting these Beta Terms, you confirm you meet this requirement.

Employees of direct competitors of Curilum are not permitted in the Beta Program without prior written consent.

4. Your Account

4.1 Accuracy

You agree to provide accurate and complete information when creating your account. Resume and profile data you input may be professional representations — you are responsible for its accuracy.

4.2 Security

You are responsible for:

  • Keeping your password secure
  • Activating multi-factor authentication (MFA) where available
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access

4.3 One Account Per Person

You may not create multiple beta accounts using different invite codes to circumvent usage limits or quotas.

5. License to Use

5.1 Grant

Subject to these Beta Terms, Curilum grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Beta Program for your personal, non-commercial evaluation and genuine job-search purposes.

5.2 Restrictions

You agree NOT to:

  • Reverse engineer, decompile, or attempt to extract source code
  • Resell, sublicense, or commercially exploit access to the service
  • Use automated means (bots, scrapers) to access the service
  • Circumvent rate limits, credit systems, or feature restrictions
  • Use the service to build a competing product
  • Upload malicious content, viruses, or malware
  • Use the service to violate any law or third party's rights
  • Use the service to generate spam or unsolicited communications
  • Misuse AI features (e.g., generating content misrepresenting others)
  • Impersonate another person or entity
  • Interfere with other users' access or the service's operation

5.3 Credit System

Some features consume "credits" (e.g., resume tailoring, cover letter generation, certificate translation). During beta:

  • Each beta account receives an initial credit allocation at signup
  • Additional credits may be granted manually by Curilum at our discretion (e.g., upon request, as a reward for feedback)
  • Credit costs per feature are displayed before use
  • Unused credits are not transferable to the post-beta paid product unless explicitly announced
  • Credits have no monetary value and are not refundable or exchangeable for cash
  • We reserve the right to adjust credit allocations or costs at any time during beta

6. AI-Generated Content

6.1 How AI Features Work

Curilum uses large language models (Google Gemini via Vertex AI) to assist with:

  • Tailoring resumes to job descriptions
  • Generating cover letters
  • Translating work certificates

6.2 Your Responsibilities

AI-generated content is a starting point, not a final product. You are responsible for:

  • Reviewing all AI-generated content before using it
  • Verifying accuracy of claims, dates, and achievements
  • Editing content to reflect your voice and truthfulness
  • Ensuring content complies with laws (e.g., employment discrimination, defamation)
  • Not submitting AI-generated content verbatim where such submission would be misleading

6.3 Ownership

Subject to these Beta Terms:

  • Your input data (your resume, profile, job descriptions you submit): you retain ownership
  • AI-generated content based on your input: we assign all rights in the generated output to you, subject to the license in Section 7
  • AI models, prompts, pipelines, and tuning: belong to Curilum and/or our AI provider

6.4 AI Limitations

AI can produce inaccurate, biased, outdated, or inappropriate content. We make no warranty that AI-generated content will be suitable, accurate, non-infringing, or beneficial to your job search.

7. Feedback and Improvements

7.1 Feedback License

If you provide feedback, suggestions, bug reports, feature requests, or similar input regarding the Beta Program ("Feedback"), you hereby grant Curilum a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, incorporate, and commercialize the Feedback in any way, without obligation to compensate you or attribute the Feedback to you.

7.2 Anonymized Usage Data

We may analyze anonymized and aggregated usage data from beta testers to improve the service. Such data does not identify you personally. See our Privacy Policy for details.

7.3 No Obligation

Providing Feedback does not obligate us to implement changes or provide compensation.

8. Confidentiality

8.1 Pre-release Information

During the Beta Program, you may have access to:

  • Unreleased features
  • Performance data, benchmarks, and metrics
  • Design decisions, prototypes, and roadmaps
  • Internal documentation shared with beta testers

You agree to keep such information confidential and NOT to:

  • Publish screenshots, videos, or descriptions of unreleased features publicly
  • Share access credentials with third parties
  • Discuss specific features, performance, or product direction with competitors
  • Benchmark or publicly compare Curilum's beta performance against competitors

8.2 Permitted Disclosures

You may:

  • Discuss your general impressions and job-search experience with friends/colleagues
  • Share publicly announced features
  • Provide testimonials we explicitly approve

8.3 Duration

Confidentiality obligations survive the termination of your beta access for 2 years or until the relevant information becomes publicly known through no fault of yours, whichever comes first.

9. Intellectual Property

9.1 Curilum Property

The Curilum service, including software, design, trademarks, logos, templates, AI prompts, and documentation, is owned by Curilum or our licensors and protected by Swiss and international intellectual property laws.

9.2 User Content

You retain ownership of content you upload or input ("User Content"). You grant Curilum a limited, non-exclusive license to use your User Content solely to provide the service to you — including processing it through AI sub-processors, storing it, and displaying it back to you.

This license terminates when you delete the relevant User Content, subject to retention periods described in our Privacy Policy.

9.3 Templates

Resume and cover letter templates (layouts, styles, thumbnails) provided by Curilum remain our property. You may use them to create documents for yourself but may not redistribute or resell them.

10. Privacy

Your privacy is governed by our Privacy Policy, which is incorporated into these Beta Terms by reference. By using the Beta Program, you acknowledge and accept the processing of personal data as described there.

11. Warranties and Disclaimers

11.1 AS-IS

THE BETA PROGRAM IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of AI outputs
  • Uninterrupted or error-free operation
  • Freedom from bugs, defects, or vulnerabilities
  • Suitability for any employment or commercial outcome

11.2 No Success Guarantee

Using Curilum does NOT guarantee:

  • Receiving job interviews or offers
  • Success in any application or job search
  • That AI-generated documents will be preferred by employers
  • That your resume/cover letter will pass any applicant tracking system (ATS)

12. Limitation of Liability

12.1 Cap on Liability

To the fullest extent permitted by applicable law, Curilum's total aggregate liability to you arising from or related to the Beta Program shall not exceed CHF 100 or the amount (if any) you paid to us in the 12 months preceding the claim, whichever is greater.

12.2 Excluded Damages

To the fullest extent permitted by law, Curilum is NOT liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Lost profits, lost revenue, lost business opportunities
  • Lost or corrupted data
  • Damages arising from AI-generated content
  • Damages arising from unsuccessful job applications
  • Damages arising from service interruption or termination

12.3 Consumer Rights

Nothing in these Beta Terms excludes or limits liability that cannot be excluded under Swiss mandatory law, including liability for intentional misconduct, gross negligence, or personal injury.

12.4 Free Service

You acknowledge that the Beta Program is provided free of charge. This is material consideration for the limitations in this Section.

13. Indemnification

You agree to indemnify, defend, and hold harmless Curilum and its officers, employees, and agents from any claims, damages, or expenses arising from:

  • Your breach of these Beta Terms
  • Your misuse of the service
  • Content you upload or submit that infringes third-party rights
  • Your violation of applicable law in connection with the service

14. Termination

14.1 By You

You may stop using the Beta Program at any time. You can delete your account via Settings → Delete Account. Upon deletion, your data is handled per our Privacy Policy retention schedule.

14.2 By Us

We may suspend or terminate your access to the Beta Program at any time, with or without notice, for any reason, including:

  • Breach of these Beta Terms
  • Suspected fraud, abuse, or misuse
  • Legal or regulatory requirements
  • End of the Beta Program
  • Business decisions

14.3 Effect of Termination

Upon termination:

  • Your license to use the service ends immediately
  • You should export any data you wish to retain beforehand
  • Sections 6.3, 7.1, 8, 9, 10, 11, 12, 13, 16, 17, 18, 19 survive termination

15. Changes to the Service and Beta Terms

15.1 Service Changes

We may modify, suspend, or discontinue features of the Beta Program at any time without liability.

15.2 Beta Terms Changes

We may update these Beta Terms. Material changes will be:

  • Posted with an updated "Last updated" date
  • Communicated via email to registered users
  • Effective at least 14 days after notice for material changes

Continued use after changes take effect constitutes acceptance. If you do not accept, your remedy is to stop using the service.

16. Transition to General Service

When the Beta Program ends, we may offer continued access under our general Terms of Service. We will give at least 30 days' notice before the transition and explain:

  • Any data migration or changes
  • Any pricing that will apply (beta users may receive launch promotions)
  • Whether beta credits or benefits carry over (not guaranteed)

If you do not accept the new terms, you may delete your account and receive data export per our Privacy Policy.

17. Governing Law and Jurisdiction

17.1 Governing Law

These Beta Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

17.2 Jurisdiction

The ordinary courts of Zurich, Switzerland have exclusive jurisdiction over any dispute arising from or relating to these Beta Terms, subject to any mandatory consumer protection laws granting you different jurisdiction based on your residence.

17.3 Consumer Protection

If you are a consumer residing in the EU/EEA, nothing in these Beta Terms deprives you of protections under applicable mandatory consumer law of your country of residence.

18. Miscellaneous

18.1 Entire Agreement

These Beta Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Curilum regarding the Beta Program.

18.2 Severability

If any provision is held unenforceable, the remaining provisions remain in full effect.

18.3 No Waiver

Failure to enforce any provision does not waive our right to enforce it later.

18.4 Assignment

You may not assign your rights under these Beta Terms. We may assign our rights and obligations to any affiliate or successor entity.

18.5 Force Majeure

Neither party is liable for failures due to events beyond reasonable control (natural disasters, war, infrastructure outages, government action).

18.6 Language

These Beta Terms are provided in English. Translations (German, French) are for convenience only; the English version prevails in case of conflict, subject to mandatory consumer law in your jurisdiction.
